Experience shows that UK residents usually buy property in Spain
through one of two routes –
1. Via a UK business that partners with a Spanish business or
2. Via a Spanish business that markets directly to the UK
Depending upon the companies in question, these routes offer
you different levels of protection if something should go wrong.
Exactly who YOU choose, too, could have a very big impact!
When it comes to property buying, if you were to rate your safety
net in terms of a star rating, where zero stars means you have
no protection and three stars means you have the best protection
you can get, which would you rather have? Nought or three star
protection? It’s an easy choice isn’t it?
However, in both the options above (1 or 2), either, neither
or both companies could be properly registered with the relevant
authorities. If they are properly registered, you’ll potentially
have some come back via the relevant legislation if something
goes wrong. If they are not registered, when things get tricky,
it’s not unknown for business owners to disappear (maybe
with your money… and if not your money, certainly your
sanity!).
So why put yourself at risk?
Scenario |
Type of Company You Buy From |
Level of Protection |
A |
A properly registered UK limited company partnering with
a properly registered Spanish limited company |
One plus one - for a total of two stars |
B |
A properly registered UK limited company partnering with
an unregistered Spanish company |
One star |
C |
An unregistered UK company partnering with a properly registered
Spanish limited company |
One star |
D |
Neither company is registered |
Zero stars! |
So clearly you need to be in scenario A above, with both companies
properly registered. But many people unwittingly put themselves
into scenario B, C or even D without realising or thinking
about it.
But we said you can have three star protection, didn’t
we? Not just two.
Correct. You can.
The way we operate is as follows – we’re a properly
registered limited company [Number 05554001], so there’s
your first protection star. Our partner in Spain - Medsea Estates
Group [Number B53329223] - operates a group of properly registered
Spanish limited companies - there’s your protection star
number two. The Spanish group of companies is owned by Medsea
Estates Group PLC in the UK [Number 05123368] and there’s
your third protection star.
How does this better protect you?
As you’ll know, as a public limited company, Medsea has
to conform to legislation, ethics and business practices at a
level higher than that of a normal limited company. Legislation
demands a higher level of disclosure which really opens up the
company to public scrutiny.
Aside from the legal aspects of this, sharp business practice
for any listed company negatively impacts its share price. And
one of the primary focuses of the Board of any PLC is its share
price. So sharp business practice, amongst any of its subsidiaries
or any of its suppliers or partners are something you’ll
not have to contend with!
Perhaps an even simpler way to look at this might be like this.
You could deal directly with a Spanish-owned and run, possibly
unregistered company. Or you could deal with us… UK based
and registered, working with a properly registered company partner
in Spain that has a mix of English and Spanish management. The
Spanish group is owned by a UK PLC.
Think about it. In this environment…
- Who speaks English not only fluently but as their first language?
- Which is going to be easier to deal with?
- Who gives you more
avenues to explore when it comes to getting things done?
- Who
has more resources and far more staff?
We’re sure you get the point.
There one more point related to this, too, that you have to
know about.
Who would you rather have as an advisor – someone who
is paid to give you advice? Or a commission-only sales person?
(A commission-only sales person only ever makes money if
you buy from them. The salaried person earns money whether
you buy or not).
Who do you think might be likely to give you the most reliable
advice? Who do you think you could more likely trust? In our "About
Us" section you can read about the salaried staff that will
act as your advisors in Spain.
We are very unusual in this respect - just about any other company
you could choose to go on tour with uses commission-only sales
people. If you doubt us, ask the question of our competitors
BEFORE you
think about booking a tour.
Next – Geoff’s mistake – and others like it
that we'll show you how to avoid.
